These Terms & Conditions govern access to and use of the SPEED platform and associated materials provided by Sean Morton Insurance Agency Inc.
VIRTUAL TRAINING AGREEMENT
THIS IS A LEGAL AGREEMENT BETWEEN YOU (“AGENT” or “YOU”) AND SPEED Training / Sean Morton Insurance Agency Inc. (“PRESENTER”). By registering for or accessing the SPEED platform, you agree to be legally bound by all of the terms and conditions of this Enrollment Agreement (the “Agreement”).
1. Use of Training Materials
Agent agrees as follows:
a. The Training Materials (defined below) are the sole and exclusive property of Presenter or its licensors. Agent will not allow the Training Materials or any portion thereof to be used except by its employees while accessing the training.
b. Agent shall not cause or allow its employees to copy, reproduce, or duplicate any of the Training Materials in any way, form, or manner, electronic or otherwise.
c. Agent shall not cause or allow its employees to directly or indirectly distribute, display, perform, publish, or create derivative works from the Training Materials or any portion thereof in any form, including online.
d. Neither Agent nor its employees are permitted to record any portion of the training in any audio, video, or other format. No photography, videotaping, filming, audio recording, or similar reproduction is permitted.
2. Access and Subscription Fees
The cost of the virtual training program is based on Presenter’s then-current subscription pricing, as published or otherwise communicated to Agent at the time of enrollment or renewal.
By enrolling in the program and providing a valid payment method, Agent authorizes Presenter to charge all applicable subscription fees in advance on a recurring basis in accordance with the selected plan.
All fees are non-refundable except as expressly required by law.
If the payment method on file is declined, expired, or otherwise fails for any reason, Agent agrees to promptly provide updated payment information. Presenter reserves the right to suspend or terminate access to the platform and related materials until payment issues are resolved.
Access to the SPEED platform is limited to the subscribing Agent and employees within that Agent’s office. Login credentials may not be shared with individuals outside the subscribing agency.
3. Cancellation and Renewal
Agent may cancel its subscription by providing written notice to Presenter at least thirty (30) days prior to the end of the then-current billing cycle.
Failure to provide timely written notice will result in automatic renewal of the subscription at Presenter’s then-current pricing, and Agent expressly authorizes Presenter to charge the payment method on file for such renewal.
No partial refunds or prorated credits will be issued for early termination.
4. Access Period and Data Deletion
Presenter provides access to the SPEED platform while the Agent maintains an active subscription. Certain hosted materials and system components are supported for a minimum period of twenty-four (24) months from the Agent’s initial enrollment date.
If a subscription is canceled, terminated for non-payment, or otherwise ends, or if the Agent is outside the applicable access period, all access to the SPEED platform and related resources will immediately cease.
In such event, all content associated with the Agent’s account—including but not limited to email templates, icons, images, documents, workflows, automations, and tools—will be permanently deleted from Presenter’s servers, and access to these resources will be terminated.
Presenter has no obligation to retain, restore, or provide copies of any such content after termination or expiration.
Agent acknowledges and agrees that data deletion is final and irreversible.
Agent is responsible for maintaining copies of any materials or records they wish to retain outside the platform prior to cancellation or termination of access.
This clause survives termination of this Agreement.
5. Platform Updates and Modifications
Presenter continually updates and improves the SPEED platform, including templates, scripts, workflows, training materials, and associated tools to reflect changes in technology, communication practices, compliance requirements, and platform capabilities.
Agent acknowledges that the SPEED platform is an evolving system and that materials may change over time as part of ongoing improvements to the platform.
Agent acknowledges that certain materials rely on hosted assets, linked resources, platform integrations, and external systems that may change over time. Continued access to the most current versions of these materials is provided through an active SPEED subscription.
Presenter may also modify, replace, or retire specific templates, scripts, images, or tools as part of platform improvements or compliance updates.
6. Recording and Participation
By participating in the training, Agent understands that portions of the training may be recorded in video or audio and/or captured in still or digital photographs.
Agent grants Presenter and its affiliates the right and permission to use in perpetuity the participant’s name, likeness, photographic images, voice, and/or testimonial in any media for the purpose of advertising and publicizing Presenter’s products and services.
Presenter owns all rights, title, and interest, including intellectual property rights, in any audio, video, or photographic recordings captured during the training.
7. Intellectual Property Rights
Agent acknowledges that participants may receive access to certain materials, information, methodologies, and other creative output (“Content”).
This Content is owned by Presenter and its employees, licensors, representatives, business associates, consultants, lecturers, and independent contractors participating in the training (“Contributors”).
Presenter and Contributors retain all right, title, and interest in their respective Content under copyright and other applicable laws.
Except as described in this Agreement, such rights are not licensed or otherwise transferred by mere attendance or registration.
Agent accepts full responsibility and liability for any use of Content in violation of these rights.
Presenter is not responsible for misuse of Content by third parties.
8. Program Materials
All materials displayed or distributed during the training or provided through the platform—including class handouts, teaching materials, presentations, audio or video material, graphics, slides, drawings, pictures, animations, text, and data (“Training Materials”)—are the sole and exclusive property of Presenter or its Contributors.
The Training Materials shall remain at all times the property of Presenter and/or its Contributors.
Agent shall not copy, distribute, display, publish, perform, or create derivative works from the Training Materials or Content without prior written permission from Presenter.
Access to Training Materials is granted solely during an active subscription period and within the access period described in this Agreement. Certain Training Materials rely on hosted images, linked assets, system integrations, and platform functionality maintained by Presenter.
These elements may be modified, replaced, or removed at any time as part of system updates, compliance requirements, or platform improvements.
9. Use of Materials and Compliance Responsibility
Agent acknowledges that the templates, scripts, workflows, and training materials provided through the SPEED platform are educational resources intended to assist agencies with communication and operational processes.
Agent is solely responsible for ensuring that any use, customization, or distribution of these materials complies with applicable laws, regulations, licensing requirements, and carrier guidelines, including but not limited to marketing, solicitation, and communication rules.
Presenter does not review, monitor, or approve individual communications sent by users of the platform and assumes no responsibility for how materials are implemented or modified by the Agent or their employees.
10. Limitation of Liability
Agent agrees to release and hold harmless Presenter and its affiliates, officers, employees, contractors, and representatives from any claims, damages, losses, or expenses arising from participation in the training or use of the platform.
Agent understands that this release may prevent them or their successors from bringing claims or legal actions against Presenter relating to participation in the training or use of the materials provided.
11. Indemnification
Agent agrees to indemnify, defend, and hold harmless Presenter and its parent company, affiliates, subsidiaries, officers, directors, employees, representatives, agents, contractors, and successors from any claim, demand, damage, cost, or expense (including reasonable attorney fees) arising out of or relating to any violation of this Agreement.
12. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Colorado, without regard to conflict of law principles.
13. Changes to Terms
Presenter reserves the right to update or modify these Terms & Conditions at any time. Updated versions will be posted on the SPEED website and will become effective upon posting. Continued use of the SPEED platform after such updates constitutes acceptance of the revised Terms.

EVENT ENROLLMENT AGREEMENT
THIS IS A LEGAL AGREEMENT BETWEEN YOU (“REGISTRANT” or “YOU”) AND SPEED Training / Sean Morton Insurance Agency Inc. (“PRESENTER”). By registering for and attending any event, you agree to be legally bound by all of the terms and conditions of this Agreement.
1. Use of Event Materials
a. Program Materials are the sole and exclusive property of Presenter or its licensors and may be used only for personal educational purposes.
b. Registrant shall not copy or reproduce any of the Program Materials.
c. Registrant shall not distribute, display, perform, or create derivative works from the Program Materials.
d. Registrants may not record the event in any format including audio, video, or photography.
2. Event Changes or Cancellation
The Event is subject to change or cancellation at any time. Presenter reserves the right to modify the agenda, speakers, or schedule without notice.
3. Event Recording
Portions of the Event may be recorded or photographed. Registrant grants Presenter permission to use such recordings for promotional purposes.
4. Intellectual Property
All materials provided during the Event remain the property of Presenter or its Contributors and may not be reproduced or distributed.
5. Acknowledgment of Risk
Participation in the Event is voluntary and at the Registrant’s own risk.
6. Release of Liability
Registrant agrees to release and hold harmless Presenter and its affiliates from claims relating to participation in the Event.
7. Indemnification
Registrant agrees to indemnify and defend Presenter from any claims arising from violation of this Agreement.
